Personal Health Information Practices
As per the Personal Health Information Protection Act, 2004, the Algonquin Nursing Home promotes the health and well-being of the residents by collecting, using, and disclosing personal health information.
The Personal Health Information Protection Act, 2004:
• Sets out the rules “health information custodians” must follow when collecting, using and disclosing residents’ personal health information.
• Gives residents the right to request access to and correction of their personal health records.
Algonquin Nursing Home is the health information custodian under the Act for the residents.
Consent
Often, Algonquin Nursing Home will collect, use and disclose residents’ personal health information with their consent. In cases where Algonquin Nursing Home will collect, use or disclose personal health information without your consent, it will do so only where it has authority to do so under the Act.
Collection of Personal Health Information
The Algonquin Nursing Home collects personal health information directly from the resident, from a person acting on the resident’s behalf, and from others, such as healthcare providers. As a health information custodian, ANH will not collect personal health information if other information will serve the purpose. In addition, ANH will not collect more personal health information than is reasonably necessary to meet the purpose.
Uses and Disclosures of Personal Health Information
ANH uses personal health information required to provide long-term care services and run the nursing home. If the personal information we require is collected for a reason other than to provide this service, your consent will be obtained before or at the time the information is collected.
Practices and Safeguards to Protect Confidentiality and Security of Personal Health Information
ANH has well-established policies, physical safeguards, and practices in place to maintain the confidentiality and security of information in its custody and under its control. For example, ANH requires all employees and volunteers to sign a Confidentiality Statement. ANH maintains physical safeguards, such as restricted access for health information files. Also, technical safeguards include unique identification passwords for access to electronic systems.
Accessing and Protecting Residents’ Records of Personal Health Information
Under the Privacy Law, you have the right to ask for access to and correction of your records of personal health information. If you want to see your personal health information records, you must complete a Request for Access to Personal Health Information form. If you would like corrections to your personal health information records, you must complete a Request for Correction to Personal Health Information form.
